The Applicant had been refused a permit by the Council to build three three-storey apartments on the site in 2014. He appealed at VCAT in 2016 where the Council's decision was overturned and a permit was granted in March 2016. The site remains undeveloped although an extension has been granted which is due to expire on 30 March 2020.
While the arguments in the document ultimately proved unsuccessful they raise interesting points regarding planning and heritage.
